I have nothing good to say about FB but my first impression is that this suit probably won't anywhere.
The key is in the word 'reach' , in the Chicago example I bet the contract doesn't specify Chicago or environs. People living in Alaska/Mongolia etc. who are FB 'friends' of someone in Chicago are part of the advert's 'reach'.

This is a legal requirement. Under a first to file patent system the first physical filing is the one that gets the patent. Hence the requirement for a time stamp step. An email would have to be printed then time stamped or have some way to validate time of arrival. This could be done but getting the courts to accept it would take some doing.
Just a small correction here. You seem to have been infected by the NRA description of .22s as 'plinking (sp?)' guns, so a couple of properties is good enough to stop the bullets. Fact is that when I first encountered them a .22 long rifle round was classified as potentially lethal up to 2 miles i.e. you don't have to have an aimed target to kill someone.
Little known fact: Most national level agencies that did that sort of thing preferred slightly overloaded .22 long rifle rounds for assassination. More of the kinetic energy would be transferred to the target, and distance was not normally a factor.
It is actually a concept in all legal codes I've come across. Basically it means that if for e.g. you hire a plumber to fix your kitchen sink at an approximate time, you have almost no chance of a successful trespass claim if said plumber is on you property anywhere near that time.
That said, I don't see how it would work in this case.

No need to invoke stress etc to explain things.
The snippet in the article makes it damn plain that the camera was part of the official profile for the EVA, but wasn't a critical part of the the mission. As such it would have been included in the pre-EVA checklist as something like 'is camera firmly attached to point X on suit' and is it unobstructed.
The camera should have been prepped (and possibly attached) prior to the astronaut even seeing it for the first time. The next step involving the camera would be: '... and then press button Y to turn on the camera:- report status', which is exactly what happened.
I'm most impressed that the astronaut didn't at some point say "you wankers sent this up here without an SD card, didn't you? OH FUCK! I'm relying on you to get home".

If you don't put it the database to begin with you don't have to find it to delete it.
Put the pre-conviction images in a PRE-FUCKING-CONVICTION database and only transfer them on conviction. That way you can just delete them from the pre-conviction database, after X amount of time, regardless of conviction status: simples.
The local plod should work on the same basis. Once it has been sent to the national register, it gets purged automatically, they can still get the info from the central database.
