back to article Now Europe's largest trade union squeezes Euro Patent Office's pips

Pressure is continuing to build on the European Patent Office (EPO) over its treatment of staff and continued refusal to accept the results of an independent tribunal. This week, Europe's largest trade union, the Union Syndicale Fédérale (USF) wrote to all 38 members of the EPO's Administrative Council noting its "great …

It's like trying to get rid of a stubborn stain. I doubt if he'll pay much attention to them or anybody.

His terms comes soon to an end so he will leave. This will give the ruling body of the EPO an alibi for not doing much.

Still, he will pay much attention to EPO employees, at least the ones that sabotaged the brakes on his bike and whatever else has happened that made him get bodyguards. Visitor security has also been stepped up under his term.

Especially when he is doing such a great job of sorting out a bunch of unionised jobsworths.

This week, Europe's largest trade union, the Union Syndicale Fédérale (USF)

Not really. USF is the biggest union of federal public servants of the European Union. It is far from being the Europe's largest trade union, which is the European Trade Union Confederation

ETUC represents almost 45 million workers across Europe, compared to 44,000 federal public servants.

The author should also mention that SUEPO, the union he supports is part of USF.

that the EPO was recently and repeatedly castigated by the International Labor Organization (ILO) for its treatment of a former Boards of Appeals

Let's have a look to the decisions of ILO regarding EPO in 2018:

Judgment 3981: The complaint is dismissed

Judgment 3980: The complaint is dismissed

Judgment 3979: The complaint is dismissed

Judgment 3978: The complaint is dismissed

Judgment 3977: The complaint is dismissed

Judgment 3964: The EPO shall pay the complainant 4,000 euros as moral damages. The EPO shall

pay the complainant 1,500 euros as costs. All other claims are dismissed.

Judgment 3961: The complaint is dismissed, as is the EPO's counterclaim

Judgment 3960: The EPO shall also pay him moral damages in the amount of

15,000 euros. It shall pay him costs in the amount of 5,000 euros. All other claims are dismissed

Judgement 3959: The complaint is dismissed.

Judgement 3958: the EPO shall pay the complainant 10,000 euros in compensation for moral injury. It shall also pay him costs in the amount of 5,000 euros. All other claims are dismissed.

Judgement 3957: The complaint is dismissed

Judgement 3956: The complaint is dismissed

Judgement 3955: The complaint is dismissed

Judgement 3954: The complaint is dismissed

Judgement 3953: The complaint is dismissed

Judgement 3896: The application for interpretation is dismissed.

29 judgments, EPO condemned 11 times: 37% of complaints are judged in favor of complainants.

In other Labour Courts like Conseil de Prud'hommes, the ratio is twice higher, around 75%. One could suggest that complainants against EPO are litigous ones.

Once the author's nemesis will leave the EPO presidency, I wonder what will be his next whim?

      Sir,

You may have overlooked the "2018" decisions which were published early in December 2017 because they wgere of great importance. The session in January was only Part 2 of the session which was from 2017. Needless to say those other decisions were in favour of staff and in a significant way with regard to the unfair practices.

With regard to comparing tribunals, it would seem strange that any tribunal would not be 50-50 in decisions if they are limited to difficult or unclear cases in basically fair internal systems. 75% success is rather disturbing.

With regard to ILO, this had to be s seen in the light of the Council of Europe investigation which has identified problems. The ILO is purely an administrative tribunal which acts to check procedures rather than equity. Dismissals are often as a result of procedural interpretations e.g. the cases you mention include dismissing requests for a company to return private property as the request cannot be heard until the company has completely finished all disciplinary dteps (which have now been ongoing for years). In that case the appellant had no other means to make a request (civil law in the country concerned is not applicable).

With a little deeper analysis, you may appreciate that threeILO is a weak justice system which cannot equate to national law. Unfortunately.

You like to write about EPO, why don't you mention this?

EPO President proposes fee reductions for European patent users

EPO’s President Benoit Battistelli has tabled proposals to cut several fees related to the European Patent application procedure: if approved, they could save users almost 50 mln euros in 2018 alone.

Would it be because you have a personal grudge against the man?

Re: You like to write about EPO, why don't you mention this?

Potemkine, you seem to be defending Batistelli despite repeated, well documented abuse of staff.

Is this because you have a personal liking for the man?

(Or are you just a sock puppet?)
